Reasons Why Bail Can be Denied

A bail bond allows a person to stay out of jail after they have been arrested as a suspect of a crime and await their trial. Bail is granted after a judge reviews a person’s case and the person getting bail promises to attend future hearings and show up for the trial.

 

Although, there’s no guarantee a person can get bail. Bail can often be denied for a number of reasons. In this blog, let’s take a look at some of those reasons.

 

1. Repeated Crimes

A judge will review all of the concerned records of the bail applicant and then decide if they get to have bail or not. Often, a person who repeatedly commits the same time is not granted bail because it shows they haven’t learned from their past crimes.

 

2. The Applicant Has Been Deemed a Danger to Society

Bail also depends on the type of crime. For example, getting bail for bad conduct in a drunken state is not as serious of a crime, and even if a person does repeat it, they might get bail. On the other hand, if a person is arrested for murder, they might not be granted bail since they can be a danger to other people. Other examples of violent crimes that don’t get bail are armed robbery, rape, assault, etc.

 

3. Have Missed Court Dates in the Past

If you have a record of missing court dates and hearings of your trial in the past, there is a high chance the judge denied you bail. This is because you’ve been proven to disregard the promises made before getting bail in the past, and there’s no guarantee you’d do it this time.

4. Flight Risk

If a judge believes a person can leave the country or run away, they might not grant them bail. This is especially the case with immigrants and people who are not US citizens.

 

When a person flies out of the country, not only is it difficult to track them, it’s highly likely that the person won’t attend their court dates and trial hearing. Judges often conduct a thorough background check to ensure a person isn’t likely to flee and can be tracked easily.
