You repeat this statement in the court as a witness of the crime\u2014you provided the court with hearsay evidence.<\/p>\n<p><!--more--><\/p>\n<p>According to the <a href=\"https:\/\/www.in.gov\/judiciary\/rules\/evidence\/\">Indiana Rules of Court<\/a>:<\/p>\n<p><em>\u201cHearsay means a statement that\u00a0is not made by the declarant while testifying at the trial or hearing and is offered in evidence to prove the truth of the matter asserted.\u201d <strong>(Rule 801)<\/strong><\/em><\/p>\n<p><a href=\"https:\/\/www.in.gov\/judiciary\/rules\/evidence\/#_Toc373857092\"><em>The Rule (802) Against Hearsay<\/em><\/a> in Indiana suggests that hearsay evidence isn&#8217;t admissible unless there are exceptions.<\/p>\n<p>Hearsay doesn\u2019t work when it comes to criminal cases\u2014at least most of the time.\u00a0 Ahead, we\u2019ve elaborated on the unreliability of hearsay evidence and some of the <strong><em>exceptions to the rule against hearsay,<\/em><\/strong> as described in <em>Rule <\/em><a href=\"https:\/\/www.in.gov\/judiciary\/rules\/evidence\/#_Toc373857092\"><em>803<\/em><\/a> and <a href=\"https:\/\/www.in.gov\/judiciary\/rules\/evidence\/#_Toc373857093\"><em>Rule 804<\/em><\/a> of the<em> Indiana Rules of Court.<\/em><\/p>\n<p><img loading=\"lazy\" class=\"aligncenter size-full wp-image-1888\" src=\"https:\/\/delaughterbailbonds.com\/blog\/wp-content\/uploads\/2020\/10\/The-hearsay-rule-keeps-the-jury-from-convicting-someone-guilty-based-on-secondhand-information.jpg\" alt=\"The hearsay rule keeps the jury from convicting someone guilty based on secondhand information\" width=\"624\" height=\"415\" srcset=\"https:\/\/delaughterbailbonds.com\/blog\/wp-content\/uploads\/2020\/10\/The-hearsay-rule-keeps-the-jury-from-convicting-someone-guilty-based-on-secondhand-information.jpg 624w, https:\/\/delaughterbailbonds.com\/blog\/wp-content\/uploads\/2020\/10\/The-hearsay-rule-keeps-the-jury-from-convicting-someone-guilty-based-on-secondhand-information-300x200.jpg 300w\" sizes=\"(max-width: 624px) 100vw, 624px\" \/><\/p>\n<h2>Unreliability of a Hearsay Evidence<\/h2>\n<p>The rule against hearsay&#8217;s goal is to prevent the court from making judgments based on unreliable information. People convicted or charged with criminal crimes face severe consequences of their acts, and no one deserves to spend a lifetime in prison based on a false rumor. The court requires witnesses who can offer information\u2014be it hearsay evidence. The jury then cross-examines that information with other reliable evidence to assess its credibility to make a decision.<\/p>\n<h2>Exceptions to the Rule Against Hearsay<\/h2>\n<p>The following are a handful of all the exceptions to the rule against hearsay, as declared by the law court.<\/p>\n<ul>\n<li>If the witness makes a statement while or immediately after the declarant perceived the incident, it may be considered reliable evidence. For instance, if you hear a child being abused and beaten in your neighbor&#8217;s house and you report it to the police, it will be valid hearsay.<\/li>\n<li>A statement made by a person looking for medical treatment or diagnosis for themselves or someone else<\/li>\n<li>A statement that highlights the medical history, pain, present or past symptoms, or general medical condition<\/li>\n<li>A recorded recollection that explicitly reflects the knowledge of the witness.<\/li>\n<li>Certain public records may also be considered an exception against the hearsay rule.<\/li>\n<\/ul>\n<p>If you are held in custody based on hearsay evidence, you have the right to make an appeal against the court&#8217;s decision and to review reliable evidence.
