Between 1990 and 2018,\u00a0<\/span><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/www.statista.com\/statistics\/191261\/number-of-arrests-for-all-offenses-in-the-us-since-1990\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">10.3 million Americans<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0were taken into custody\u2014which is an astronomical figure!\u00a0<\/span><!--more--><\/p>\n<p><span data-preserver-spaces=\"true\">What\u2019s worse, arrests aren\u2019t always lawful or justified. In many cases, the defendant is either the wrong person at the wrong time or was wrongly accused.\u00a0\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">But being arrested doesn\u2019t mean that you\u2019re going to be sentenced. There\u2019s always a way out if you\u2019re innocent.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Here are some myths regarding arrests that you shouldn\u2019t believe:<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">The police can enter your home without a warrant<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Repeat after us:\u00a0<\/span><strong><em><span data-preserver-spaces=\"true\">no warrant, no entry<\/span><\/em><\/strong><span data-preserver-spaces=\"true\">.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Officers can only enter homes without a warrant in a limited set of circumstances\u2014known as\u00a0<\/span><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/www.law.cornell.edu\/wex\/exigent_circumstances\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">exigent circumstances.<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0These are situations where the officer feels that you might:<\/span><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\">Destroy evidence\u00a0<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Attempting to flee\u00a0<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Harm someone<\/span><\/li>\n<\/ul>\n<p><span data-preserver-spaces=\"true\">Otherwise, under normal circumstances, you need to ask the officer to present a warrant before letting them in. If the officer isn\u2019t carrying a warrant, you have every right to resist the arrest.\u00a0<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Your friends and family can\u2019t help<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Of course, they can. The law allows your immediate loved ones to step in and post bail on your behalf. They can get in touch with a bail bond agency and cosign a bond. They can also contact an attorney on your behalf and get them to proceed with the case.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">However, they can\u2019t access all the case-related information on their own. The defendant\u2019s conversations with their attorney and judge are highly privileged and protected by law.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Some states have a judiciary search website where anyone can browse through charges and see them.\u00a0<\/span><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/www.in.gov\/judiciary\/iocs\/files\/pubs-trial-court-confidentiality.pdf\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Indiana\u2019s Administrative Rule no 9<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0dictates the matter and defines the extent to which arrest-related information is available to the public.\u00a0<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">The bail amount is fixed<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">This is untrue. In fact, you\u2019d be surprised to know that a judge might even let you go on the basis of a signed promise that you\u2019ll show up for court hearings. This is known as personal recognizance.\u00a0<\/span><a class=\"_e75a791d-denali-editor-page-rtfLink\" href=\"https:\/\/definitions.uslegal.com\/p\/personal-recognizance\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This pretrial release<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0is always decided by the judge, and is granted in the case of minor offenses such as traffic violations or technical crimes.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Other than that, the judge decides the final bail amount after considering the defendant\u2019s past criminal record, flight risk, and the nature and severity of the crime.
